Expertise

Ruadhán is a partner in Matheson's Commercial Litigation and Dispute Resolution Department. 

He advises on a broad range of commercial disputes, specialising in planning and environmental, real estate, construction and administrative matters.  He also represents clients in regulatory investigations and the defence of criminal proceedings, as well as advising on transactional matters (including due diligence and transaction document negotiation).

Ruadhán represents clients at all jurisdictions, up to the Supreme Court and Courts of Justice of the European Union, and in alternative dispute resolutions such as mediation, conciliation, arbitration, adjudication and expert determination.  

Experience Highlights 
  • Advising an international aquaculture operator on all aspects of licensing and regulatory compliance, including successful defences of a number of enforcement actions for alleged licence breaches and bringing judicial review proceedings to challenge an attempt to revoke an operating licence. 
  • Advising a North American oil producer and retailer on its acquisition of an Irish retail petrol operation.  Leading the environmental due diligence, which included advising on liability in respect of over 150 sites.  Advising on implementation of a compliance programme post-acquisition.
  • Advising an international waste management company on its successful application for planning permission for a waste to energy facility.  Representing the company in the defence of a High Court judicial review challenge to that grant of permission.  Advising the company on its application for its operating permit.
  • Advising a number of residential property developers on applications for planning permission under the SHD and LRD schemes.
  • Representing an international engineering firm in the successful defence of a dispute arising from an EPC contract with a value of approximately €500 million.
  • Advising a global technology company in respect of construction defects in a €300 million office and residential campus development.
  • Representing a third level educational institution in a number of claims, including for delay and liquidated damages arising from the construction of €62 million student accommodation development.
  • Representing a property developer in a High Court dispute arising from the contract to purchase a development site worth approximately €20 million.
  • Advising a gas supply company in relation to a proposed LNG and CHP facility, including defending a High Court judicial review challenge to the extension of a planning permission.
