Real Estate Tax
We collaborate closely with our colleagues in our Commercial Real Estate Group and Finance and Capital Markets Group to provide a one-stop-shop for all real estate related legal and tax issues.
In the context of real estate transactions, we advise purchasers, sellers, landlords, tenants, developers, funders, and managers on all aspects of the structuring, purchase, financing, leasing, development, holding and sale of Irish real estate. We advise builders and developers across all stages of the development life cycle, whether that be advising on the tax aspects of funding and real estate acquisition or advising on how best to structure the return for investors in the development. We advise investors (both professional and private, including real estate purchasers and loan portfolio purchasers), syndicate organisers, and lenders. We advise lenders on the work-out of real estate loans and review tax papers prepared by borrowers in relation to new borrowings, re-financings and group structures / reorganisations. We also offer advice regarding tax structures that have been put in place in respect of specific real estate transactions. Examples include capital allowances based transactions for hotels, student accommodation and hospitals and the complex issues that have arisen with such structures in enforcement scenarios in recent years.
Tax is often a key part of the cost structure for a real estate investment or development and our clients seek to manage this cost carefully, through appropriate planning and strategic negotiation with counterparties. Our advice includes identifying optimum structuring options for the acquisition, development and financing of real estate, the negotiation of the tax aspects of real estate transactions, analysing the stamp duty implications of real estate transactions and providing ongoing compliance advice in relation to real estate investments.
